NOTICE OF PROPOSED BOUNDARY ADJUSTMENT AND JOINT PUBLIC HEARING

Notice is hereby given that the Taylorsville-Bennion Improvement District (“Taylorsville-Bennion”) and the West Jordan City (“West Jordan”) intend to adjust their common service area boundary. This Notice is being provided to you because you have been identified as an owner of property located within the affected area and/or as a registered voter residing within the affected area.

The Board of Trustees of Taylorsville-Bennion and the City Council of West Jordan have adopted a joint resolution indicating the Board’s intent to adjust the common service area boundary between the district and the city pursuant to the provisions of Utah Code Ann. §§ 17B-1-503; 17B-1-417.  Both Taylorsville-Bennion and West Jordan provide water and sewer service. Taylorsville-Bennion’s service area is primarily, although not exclusively, located in Taylorsville City, and West Jordan’s service area is primarily, although not exclusively, located in West Jordan City.  The affected area is described in Exhibit A which accompanies and is part of this Notice. Please refer to the exhibit to determine which entity your property will be moving to. The intention of this boundary adjustment is to adjust the service area boundaries and ensure that the legal service area boundaries of the entities reflect which entity is actually providing service currently—you will not be experiencing a change in service. (In some cases, services in certain areas are split, with one entity providing water and another providing sewer. In these cases, you will continue to be located solely within one service area, and the two entities will enter an agreement regarding the splitting of services.) That agreement will state that if only one service is provided by Taylorsville-Bennion to a property owner, the district will credit half of the property taxes back to the property owner. The municipal boundaries of West Jordan will not change.

The Taylorsville-Bennion Board of Trustees will hold a public hearing on the proposed boundary adjustment at 3:00 p.m. on July 21, 2021, at the District Office located at 1800 W 4700 South, Taylorsville, UT 84129.

 

The West Jordan City Council will hold a public hearing on the proposed boundary adjustment at 7:00 p.m. on July 28, 2021, at the City Hall located at 8000 S. Redwood Road, West Jordan, UT 84088.

 

Taylorsville-Bennion imposes a property tax and fees. Taylorsville-Bennion’s certified property tax rate for 2020 was 0.000112.  Taylorsville-Bennion and West Jordan charge certain other service fees as well as impact fees, most usually on new developments. After the service area boundary adjustment, the owners of property within the affected area will be subject to the payment of property taxes of the entity indicated on Exhibit A (unless you are exempt from property taxes).  The rates are subject to change over time. For more information concerning other service rate structures and the financial and service impacts of the boundary adjustments, please call the numbers that appear at the end of this notice.

The Taylorsville-Bennion Board of Trustees and the West Jordan City Council may adjust the common service area boundary of the two entities in accordance with Exhibit A which is part of this notice unless, at or before the later of the two public hearings, written protests to the adjustment are filed with either or both entity by: 

 

(A)       the owners of private of real property that: (1) is located within the affected area; (2) covers at least 50% of the total private land area within the affected area; and (3) is equal in assessed value to at least 50% of the assessed value of all private real property within the affected area; or

 

(B)       Registered voters residing within the affected area equal in number to at least 50% of the votes cast in the affected area for the office of Governor at the 2020 general election.

This notice is being given jointly as allowed by Utah Code Ann. § 17B-1-417(3)(d) and is being published as required by Utah Code Ann. § 17B-1-417(3)(a)(iii).

This Notice is being provided to you because you have been identified as an owner of property located within the affected area and/or as a registered voter residing within the affected area.

The Board of Trustees of Taylorsville-Bennion and the City Council of Murray have adopted a joint resolution indicating the Board’s and Council’s intent to adjust the common service area boundary between the district and the city pursuant to the provisions of Utah Code Ann. §§ 17B-1-503; 17B-1-417.  Both Taylorsville-Bennion and Murray provide water and sewer service. NOTICE is hereby given that applications for filing for candidacy in the Taylorsville-Bennion Improvement District Trustee regular election will be received beginning June 1, 2021 through June 7, 2021 ending at 4:30  p.m., at the District offices located at 1800 West 4700 South.

Candidate qualifications:

  1. Be a U.S. citizen at the time of filing
  2. Be a registered voter
  3. Be a resident of the District and live within Voting Division #3 as the District is divided
  4. Non-partisan
